Bolsonaro Nears Conviction in Coup Attempt Trial
Two Supreme Court Justices Vote for Conviction
Brazil’s former President Jair Bolsonaro is one vote away from a coup conviction. On Tuesday, two justices on the Supreme Court voted to convict him for trying to illegally stay in power after losing the 2022 election.
The trial is being held by a five-judge panel. With two votes already cast, three more are expected in the coming days. Sessions will continue daily through Friday.
De Moraes Calls Bolsonaro Coup Leader
Justice Alexandre de Moraes, who oversees the case, described Bolsonaro as the leader of a criminal organization and a coup plot. He voted to convict, stating:
“Brazil almost returned to a 20-year dictatorship,” referencing military rule from 1964 to 1985.
De Moraes outlined key actions he believes show Bolsonaro’s intent to seize power:

- Discrediting the electoral system
- Drafting a decree to cancel the election results
- Inciting the January 8, 2023, riots aimed at triggering military intervention
He rejected Bolsonaro’s argument that his actions stayed within the law.
“This was a draft decree for a coup d’état,” he said. “A series of executive actions were aimed at destroying democracy.”
Tensions Rise in Courtroom
Justice Flávio Dino also voted to convict. While Justice Cármen Lúcia appeared supportive, Justice Luiz Fux signaled he would oppose parts of the ruling. Security was tight, with armed officers stationed throughout the court.
Bolsonaro did not attend the session. His legal team declined to speak with reporters.
